Who is a "competent person" for the purposes of PUWER?
A person "possessing the knowledge or experience required to enable them to satisfactorily perform the duties required by the Regulations". PUWER is deliberately vague. In most cases in practice, a ship's officer will not be a "competent person" to perform a 5-yearly test, whereas after appropriate training an officer may be a "competent person" for the purpose of inspections of equipment.
Under STCW 2010, what training must crew members be given before being assigned to any shipboard duties?
(1) Safety familiarisation training in accordance with Section A-VI/1.1;
Which organisation issues Certificates of British Registry?
The Registry of Shipping and Seamen (RSS).

SOLAS regulation XI-2/8. 2 provides as follows: "If, in the professional judgement of the master, a conflict between any safety and security requirements applicable to the ship arises during its operations, the master shall give effect to those requirements necessary to maintain the safety of the ship.
Which organisation(s) can issue a Passenger Ship Safety Certificate to a UK ship?
Only the MCA. A Recognised Organisation may carry out some of the initial survey or renewal survey work, but they cannot issue PSSCs.
Who draws up the SOPEP, SMPEP(NLS) or SMPEP for a UK ship?
The shipowner. IMO and the International Chamber of Shipping publish guidelines on the development of plans.
Which UK ships must carry an up-to- date copy of Volume III of the IAMSAR Manual?
All UK ships of 150 GT or more on international voyages, and all UK ships of 500 GT or more on domestic voyages.
What is shown in the Appendix to a chemical tanker Certificate of Fitness?
A list of additional products which, although not shown on the Products List of the COF, the ship is suitable to carry. (Certain chemical products are assessed for inclusion in Annex III of MARPOL and are therefore not required to be shown on a COF.) Other sections of the Appendix mirror those of the COF.
A shipowner tells a master to stow a piece of unprotected machinery on deck for a coastal voyage, even though the cargo could easily be stowed under deck. Will the owners be breaching the contract of carriage?
Even when there is no express or implied agreement for under-deck stowage, it may well be a fundamental breach of the contract of carriage to stow cargo on deck which is not suitable for on-deck carriage.
How are Statutory Instruments (SIs) relating to merchant shipping produced and given legal force?
They are drafted by lawyers and officials of the Department for Transport (DfT), in some cases go through a public consultation period (see Ships and Cargoes/Consultations on the MCA website), are laid before Parliament for approval, get the consent of both Houses of Parliament, and come into force on a specified date. Fragment-->Statutory Instruments (SIs) made under Acts of Parliament, consisting mainly of Regulations, e. g. The Merchant Shipping (Safety of Navigation) Regulations 2002, but also including Rules and Orders, e. g. The Formal Investigation Rules 1985, and The Ministry of Defence Ships Order 1989. Byelaws (including harbour byelaws) are another type of secondary legislation.
