The party who appointed the agent and will be paying the agency fee. If the shipowner will be paying the agency fee, the owner is the agent's principal, regardless of whether the charterer or another party nominated the agent. Note: Nominating an agent means naming the agency firm to be used; this is not the same as appointing the agent. (See notes on Agents under VOYAGE CHARTERS and TIME CHARTERS in Section F. )

The safety requirement. SOLAS regulation XI-2/8.2 provides as follows: "If, in the professional judgement of the master, a conflict between any safety and security requirements applicable to the ship arises during its operations, the master must give effect to those requirements necessary to maintain the safety of the ship. In such cases, the master may implement temporary security measures and must inform the flag State Administration and, if appropriate, the port State."
