When (1) an accident has occurred to or in a ship; and (2) in the opinion of the Secretary of State, the accident has created a risk to the safety or a risk of significant pollution by a hazardous substance in the UK, in the UK's territorial sea or in the UK's Pollution Control Zone; and (3) in the opinion of the Secretary of State, the use of the powers is necessary to remove or reduce the risk.
